Manifestación de impedimento formulado por el doctor Alejandro Linares Cantillo.
El magistrado indicó que estaba impedido para participar en la decisión que se llegare a proferir en el proceso de la referencia, por estar incurso en la causal prevista en el numeral 1 del artículo 56 del Código de Procedimiento Penal.
Lo anterior, debido a que “la decisión que se pueda adoptar respecto de este expediente podría dar lugar al establecimiento de reglas jurisprudenciales que eventualmente deriven en un interés de [su] parte, considerando [su] afiliación actual al Régimen de Ahorro Individual (RAIS).” Luego de analizar la petición del magistrado consideró la Sala que el supuesto hecho que él expresó no se subsume dentro de la hipótesis descrita en la causal invocada.
Con base en lo anterior se decidió NO ACEPTAR el impedimento manifestado.
