La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
La Corte en aplicación al criterio a prevención y dio prevalencia a la elección de actor y, por eso, dirimió el conflicto con la remisión del expediente al Juzgado 16 Administrativo de Cartagena para que, de manera inmediata, tramite y adopte la decisión a la que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el Auto del 30 de mayo de 2025, dictado por el Juzgado 016 Administrativo de Cartagena dentro del trámite de la acción de tutela formulada por el señor Jhakson Madrid Rivas Ríos en contra de Luis Carlos Correa Ruíz, Intendente y Jefe de la Unidad Básica de Investigación Criminal del Departamento de Policía Bolívar.
- SEGUNDO. REMITIR el expediente ICC-5064 al Juzgado 016 Administrativo de Cartagena para que, de manera inmediata, tramite y adopte la decisión a la que haya lugar.
- TERCERO. Por la Secretaría General de esta Corporación, COMUNICAR la decisión adoptada en esta providencia a la parte accionante y al Juzgado 002 Promiscuo de Familia de Magangué, Bolívar.
