Se ordenó inaplicar el Art. 1 del Decreto 1382 de 2000 en el presente caso por inconstitucional.
Se dirimió la colisión de competencias suscitada entre la Sala Penal del Tribunal Superior de Pasto y la Sección Segunda del Tribunal Administrativo de Cundinamarca, en el sentido de que la competencia no le corresponde a este último Tribunal.
En consecuencia, se remitió el expediente al Tribunal Superior de Pasto, Sala Penal, que adquirió la competencia a prevención.

- En el presente caso, INAPLICASE, por inconstitucional, el artículo 1 del Decreto 1382 de 2000. En consecuencia. DECIDIR la colisión de competencias suscitada entre la Sala Penal del Tribunal Superior de Pasto y la Sección Segunda del Tribunal Administrativo de Cundinamarca, en el sentido de que la competencia no le corresponde al Tribunal Administrativo de Cundinamarca y en consecuencia por Secretaría se remitirá el expediente al Tribunal Superior de Pasto, Sala Penal, que adquirió la competencia a prevención según se dijo en la parte motiva de este auto.
