Se ordenó remitir el expediente de tutela al Juzgado Primero Civil del Circuito de Espinal para que adelante la correspondiente actuación judicial, toda vez que estando vigente el Decreto 1382 de 2000, conforme a la situación jurídica existente en la actualidad, la Corte Constitucional encuentra que, presentándose un conflicto aparente de competencia, en el presente caso el conocimiento de la tutela corresponde al mencionado juzgado en virtud de lo establecido en el Art. 1º, numeral 1º, inciso 2º, del mencionado Decreto.
