Se ordenó remitir el expediente de tutela al Juzgado 61 Civil Municipal de Bogotá para que adelante la correspondiente actuación judicial, toda vez que estando vigente el Decreto 1382 de 2000, conforme a la situación jurídica existente en la actualidad, la Corte Constitucional encuentra que, presentándose un conflicto aparente de competencia, en el presente caso el conocimiento de la tutela corresponde al citado juzgado en virtud de que el Art. 1º, numeral 1º, inciso 3º, del mencionado Decreto contempla que “a los Jueces Municipales les serán repartidas para su conocimiento en primera instancia, las acciones de tutela que se interpongan contra cualquier autoridad pública del orden distrital o municipal y contra particulares”.
