Se declaró la nulidad de todo lo actuado en la tutela promovida por el ciudadano contra el Consorcio Fondo de Pensiones Públicas del Nivel Nacional –FOPEP-, a partir del auto proferido por el Juzgado Primero Penal del Circuito de Bogotá, D.C., toda vez que el mencionado despacho judicial aplicó lo dispuesto en el Art. 1 del Decreto 1382 de 2000, norma manifiestamente contraria a la Carta Política.

En consecuencia, se ordenó remitir el expediente al citado Juzgado para que realice el trámite que corresponda conforme a la ley.
