Solicitud de nulidad del auto 707/24, mediante el cual la Corte se abstuvo de continuar el trámite de cumplimiento de la Sentencia T-296/13 y regresó la competencia de ello al juez natural.
Lo anterior, por haber desaparecido la necesidad de mantener dicha competencia preferente, en tanto ocurrió un cambio de circunstancias con relación a la situación inicial.
Los argumentos del nulicitante fueron la incongruencia entre la parte motiva y la resolutiva, así como la elusión arbitraria de asuntos de relevancia trascendental para la decisión.
Por resultar abiertamente improcedente, la Sala Plena de la Corporación decidió RECHAZAR la nulidad invocada.

- Primero. RECHAZAR la solicitud de nulidad presentada por el señor Víctor Franz Dueñas Monroy contra el Auto 707 de 2024, proferido en el marco de la competencia preferente para la verificación de cumplimiento de la Sentencia T-296 de 2013, en el trámite adelantado respecto del expediente T-3.758.508, teniendo en cuenta las razones expuestas en la parte motiva.
- Segundo. ORDENAR que, por Secretaría General, se comunique la decisión adoptada en esta providencia al solicitante, indicando que contra la misma no procede ningún recurso.
