SEGUNDO. DECLARAR que, de acuerdo con el conflicto planteado, el Tribunal Superior de Distrito Judicial de Cundinamarca, Sala Penal, es competente para conocer del proceso de tutela de la referencia.
TERCERO. PERMITIR, por medio de la Secretaria General de esta Corporacion, el expediente al Tribunal Superior del Distrito Judicial de Cundinamarca, Sala Penal, para lo de su competencia.
