La demanda se rechazó porque el actor no subsanó las falencias advertidas en el auto inadmisorio.
La Sala Plena de la Corporación concluyó que la súplica deprecada no cumplió con la carga argumentativa necesaria y que el demandante no expuso razones que dieran cuenta de que el magistrado sustanciador hubiera incurrido en algún yerro, olvido o arbitrariedad en el auto cuestionado.
Con base en lo anterior, lo RECHAZÓ, por improcedente.

- Primero. RECHAZAR, por improcedente, el recurso de súplica interpuesto por el ciudadano Cristian Ignacio Cubas Gallego en contra del auto de 15 de mayo de 2024 que rechazó la demanda de inconstitucionalidad en contra del artículo 376 de la Ley 599 de 2000, "por la cual se expide el Código Penal".
- Segundo. Contra esta providencia no procede recurso alguno.
