Se remitió el expediente de tutela a la Corte Suprema de Justicia, Sala de Casación Penal, para que adelante la correspondiente actuación judicial, toda vez que La Corte, teniendo en cuenta que en la tutela también se debe garantizar el debido proceso, considera que, para hacer efectivo el derecho constitucional a la impugnación (artículo 31 de la Constitución Política) se hace necesario respetar la competencia a prevención fijada por el accionante.
