Se remitió el expediente de la referencia al Juzgado competente para que realice el trámite a la tutela impetrada por la accionante contra la Nación - Presidencia de la República, el Ministerio de Hacienda y Crédito Público, el Ministerio de Trabajo y Seguridad Social y el Director del Servicio Nacional de Aprendizaje, Sena.
La Corte consideró que el conflicto debe ser dirimido por el juzgado en mención porque el asunto ya había sido resuelto anteriormente por la Corte Suprema de Justicia.

- Primero. No aplicar el articulo 1o, numeral 1o del Decreto 1382 de 2000.
- Segundo. Declarar que, de acuerdo con el conflicto planteado, el Juzgado 3o Penal del Circuito de Medellin era competente para conocer, en primera instancia, el proceso de tutela de la referencia y, por lo tanto, la Sala Penal del Tribunal Superior de Medellin debe resolver la impugnacion presentada contra la Sentencia de tutela proferida por dicho Juzgado.
- Tercero. Ordenar a la Sala Penal del Tribunal Superior de Medellin revocar, en lo referente a la accionante, el auto de junio 20 del presente ano y, en su lugar, resolver la apelacion interpuesta.
- Cuarto. Remitir, por medio de la Secretaria General de esta Corporacion, el expediente al Tribunal Superior de Medellin, para lo de su competencia.
