Se declaró la nulidad de todo lo actuado en la tutela instaurada por el ciudadano de la referencia contra el Municipio de Algeciras y Otros, a partir del auto proferido por el Juzgado 1º Penal del Circuito de Neiva.
Lo anterior, porque se actuó conforme a lo dispuesto por el Art. 1º del Decreto 1382 de 2000, precepto normativo que no resultaba aplicable por ser inconstitucional.
En consecuencia, se ordenó remitir el expediente al mencionado juzgado para que asuma el conocimiento del proceso en referencia y realice el trámite que corresponda de acuerdo con la ley.

- Primero. DECLARAR la nulidad de todo lo actuado en la accion de tutela, incoada por Mario Guzman Perdomo y Guillermo Pastrana Rodriguez, contra el Municipio de Algeciras y Otros, a partir del auto del 25 de julio de 2000, proferido por el Juzgado 1o Penal del Circuito de Neiva.
- Segundo. REMITASE el expediente por Secretaria General, al Juzgado 1o Penal del Circuito de Neiva, para que de manera inmediata asuma el conocimiento del proceso en referencia y le imprima el tramite que corresponda de acuerdo con la ley.
