Se declaró la nulidad de todo lo actuado en la acción de tutela promovida por la ciudadana de la referencia contra el Ministerio de Salud, Fondo Pasivo Prestacional del Sector Salud y la Fundación San Juan de Dios, a partir del auto proferido por el Juzgado Noveno Civil del Circuito de Bogotá, lo anterior, porque se aplicó el Art. 1 del Decreto 1382 de 12 de julio de 2000 que, como ya se dijo, no resulta aplicable por ser contrario a la Carta Política.
Se ordenó remitir el expediente al citado despacho judicial para que realice el trámite que corresponda conforme a la Ley.

- Noveno. Civil del Circuito de Bogota, visible a folio 8 del expediente.
- Segundo. REMITASE el expediente por Secretaria al Juez
- Noveno. Civil del Circuito de Bogota, para que, de manera inmediata se le imprima a esta accion de tutela el tramite que corresponda conforme a la Ley.
