Se inaplicó el Art. 1º del Decreto 1382 de 12 de julio de 2000, por ser contrario a la Constitución Política, en relación con la tutela promovida por el ciudadano de la referencia contra el Seguro Social y el Fondo de Ahorro y Vivienda Distrital.
En virtud de lo anterior, debe declararse que la competencia para conocer de la tutela corresponde al Juzgado Tercero Laboral del Circuito de Bogotá.
Esto es así porque la tutela se dirigió al Juez Laboral del Circuito de Bogotá y por reparto le correspondió a aquél, siendo, por tanto, el competente para su conocimiento de acuerdo con lo dispuesto en el Art. 86 de la Carta.

- SEGUNDO. Enviese el expediente al Juzgado

- TERCERO. Enviese copia de este pronunciamiento al Juzgado Sesenta y Dos Civil Municipal de Bogota.
