El incidente formulado por el apoderado judicial de los accionantes hace referencia a que la precitada providencia se apartó injustificadamente del precedente constitucional fijado por la Corporación, en lo que respecta a la obligación de motivar los actos administrativos de desvinculación.
La Sala Plena, tras comprobar que el peticionario no cumplió con el deber de argumentar cualificadamente la vulneración al debido proceso por la presunta desviación del precedente y que sólo evidenció una serie de inconformidades con el razonamiento de la Corte, decidió NEGAR el incidente formulado.
