Se revocó la providencia proferida por el Juzgado de la referencia, la Corte explicó que si el juez de primera instancia, no es el competente, la Sala considera que el procedimiento a seguir es enviar la demanda y sus anexos al juez competente.
Obviamente, previa notificación al interesado de que hará tal envío, pues sino se violaría el debido proceso al actor, quien carecería de las oportunidades procesales para actuar.
En consecuencia, se ordenó a dicho Juzgado proceder a remitir la demanda de tutela y sus anexos al juez competente, y a informar al demandante sobre dicha remisión.

- Primero. REVOCAR la providencia de septiembre tres (3) de mil novecientos noventa y seis (1996), proferida por el Juzgado Veintidós Civil del Circuito de Santa Fe de Bogotá, y, en su lugar, ordenar que dicho Juzgado proceda a remitir inmediatamente la demanda de tutela y sus anexos al juez competente, y a informar al demandante sobre dicha remisión.
- Segundo. COMUNICAR esta decisión al Juzgado Veintidós Civil del Circuito de Santa Fe de Bogotá, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
