Se declaró la nulidad de todo lo actuado en la acción de tutela de la referencia contra el Instituto de Seguros Sociales, a partir del auto proferido por el Juzgado respectivo, toda vez se le dio aplicación al Decreto 1382 de 2000 que resulta contrario a la Constitución, en tal sentido la Corte encontró que para el presente caso ha debido inaplicarse, y que no podía servir de fundamento para la competencia del juez que profirió la decisión de instancia.
Se ordenó remitir el expediente al Juzgado competente para que realice el trámite correspondiente conforme a la ley.
