Se remitió el expediente de tutela al Tribunal Superior de Bogotá, Sala Penal, para que adelante la correspondiente actuación judicial, toda vez que en el presente conflicto se tiene, por un lado, que al interponerse una tutela contra el Consejo Superior de la Judicatura, por ser ésta una autoridad pública de orden nacional, la competencia correspondería a los Tribunales Superiores de Distrito Judicial, Administrativos y Consejos Seccionales de la Judicatura.
Por otro lado, por haberse interpuesto una tutela contra la Caja Nacional de Previsión, entidad del sector descentralizado por servicios, existiría competencia para los jueces del circuito.
Al haberse presentado la acción contra más de una autoridad y ser estas de diferente nivel, la competencia le corresponde al juez de mayor jerarquía.
