- Primero. INAPLICAR , por ser incompatible con la Constitucion Politica, el Articulo 1o del Decreto 1382 de 2000.
- Segundo. DIRIMIR el conflicto negativo de competencia suscitado entre la Subseccion "b" de la Seccion Tercera del Tribunal de lo Contencioso Administrativo de Cundinamarca y el Juzgado Cincuenta y uno Civil Municipal de Bogota, de tal forma que la autoridad judicial competente para asumir el conocimiento de la accion de tutela presentada por Juan Carlos Araque Marino contra DATACREDITO Y CIFIN es la Subseccion "b" de la Seccion Tercera del Tribunal de lo Contencioso Administrativo de Cundinamarca.
- Tercero. ORDENAR que por Secretaria General se remita el expediente a la Subseccion "b" de la Seccion Tercera del Tribunal de lo Contencioso Administrativo de Cundinamarca.
