Se revocó la providencia proferida por el Juzgado de la referencia que negó la acción de tutela presentada por el accionante, toda vez que si un juez o tribunal al conocer de una acción de tutela en primera instancia se declara incompetente para resolver sobre el asunto, el procedimiento a seguir no es negar o rechazar la demanda, sino remitir la actuación al que considere competente.
En consecuencia, se ordenó remitir el expediente al Juzgado respectivo para que tramite como corresponde, según la Constitución y la Ley, la petición de tutela del demandante.

- Primero. REVOCAR la providencia de mayo veintiuno (21) de mil novecientos noventa y seis (1996), proferida por el Juzgado
- Sexto. Penal Municipal de Popayán, que negó la acción de tutela presentada por el señor Samuel Díaz Valencia.
- Segundo. ORDENAR que por Secretaría General se remita el expediente al Juzgado
- Séptimo. Penal Municipal de Cali, para que se tramite como corresponde, según la Constitución y la Ley, la petición de tutela del señor Samuel Díaz Valencia.
- Tercero. ORDENAR que por la Secretaría General de esta Corporación se comunique esta providencia al Juzgado
- Sexto. Penal Municipal de Popayán, para las notificaciones y efectos previstos en el artículo 36 del Decreto 2591 de 1991.
