Se declaró la nulidad de lo actuado a partir de la providencia proferida por el Juzgado de la referencia, la Corte argumentó que al negarse a fallar, el Juez viola el debido proceso, el derecho de acceso a la justicia y la esencia de la acción de tutela, luego su determinación constituye una nulidad insubsanable.
En consecuencia, ordenó devolver el expediente al referido Juzgado para que pronuncie sentencia sobre la tutela instaurada.
