- Primero. INAPLICAR, el articulo 1o del Decreto 1382 de 2000 por incompatibilidad con la Constitucion Politica.
- Segundo. DECLARAR que el Tribunal Administrativo de Cundinamarca es el competente para conocer de la accion de tutela formulada por el ciudadano RAFAEL ENRIQUE CELY HERAZO.
- Tercero. ORDENAR que por Secretaria General se remita el expediente de la referencia al despacho del Magistrado Jose Herney Victoria Lozano, a quien fue repartido el escrito de tutela en el Tribunal Administrativo de Cundinamarca, para que, continue el tramite de la accion de tutela conforme al Decreto 2591 de 1991.
- Cuarto. Enviese copia de este auto para su conocimiento al Juzgado Once Civil Municipal de Bogota.
