Se declaró la nulidad de lo actuado a partir del auto que ordenó remitir el expediente al Juzgado de la referencia debido a que envió el expediente al juez equivocado desconociendo la competencia funcional, es decir, el superior jerárquico.

En concordancia con lo anterior, la Corte ordenó regresar el proceso al juzgado respectivo para que tramite la segunda instancia.

Una vez resuelto lo anterior, la Corporación tomará la decisión correspondiente.

  1. PRIMERO. Declárase la nulidad de lo actuado a partir del auto de 28 de abril de 1995 que ordenó remitir el expediente al Juzgado Unico Laboral del Circuito de Aguachica.
  2. SEGUNDO. Regrese al expediente al Juzgado Penal Municipal de Río de Oro para que ordene la remisión (para trámite de la impugnación) al Juez competente según se indicó en la parte motiva a fin de que éste trámite la segunda instancia.
  3. TERCERO. Una vez tramitada la segunda instancia y cuando haya llegado a la Corte Constitucional el expediente, éste pasará al despacho del Magistrado Sustanciador para la decisión correspondiente.
