Se ordenó al Tribunal Administrativo del Tolima que asuma de forma inmediata el conocimiento de la tutela de la referencia, de conformidad con lo consagrado en los Arts. 86 de la Constitución Política y 37 del Decreto Ley 2591 de 1991, respecto del sentido de la expresión "competencia a prevención", la Corte concluye que existe un interés del ordenamiento jurídico en proteger la libertad del peticionario frente a la posibilidad de elegir el juez competente de las acciones de tutela que desee promover.
