Se abstuvo de realizar pronunciamiento de fondo en la tutela de la referencia, lo anterior, porque el mismo peticionario ya había instaurado una tutela en contra de la misma Compañía, solicitando el pago de su mesada pensional correspondiente al mes de septiembre de 1999, tutela que fue fallada por esta Sala de Revisión mediante Sentencia T-168/00, tutelando los derechos fundamentales del actor, a la vida, a la seguridad social y, a la debida protección a las personas de la tercera edad.

Así mismo, se ordenó en la citada sentencia, el pago de la mesada pensional que reclamaba y, para evitar que se tuvieran que incoar acciones de tutela por cada mes que no se pagara la correspondiente mesada pensional, ordenó también el pago de las mesadas pensionales sucesivas que se causaran.

En este sentido consideró la Corte no es procedente pronunciarse nuevamente.
