Se decretó la nulidad de lo actuado en el proceso de tutela de la referencia debido a que la Corte Constitucional reconoce que el derecho de petición exige respuesta pronta y sustancial, no sustituible por el acto ficto derivado del silencio administrativo negativo.
Por tal razón, los operadores jurídicos se encuentran frente a una doctrina constitucional que es de obligatorio cumplimiento.
En consecuencia, se ordenó devolver el expediente al respectivo juzgado para que se pronuncie sobre la cuestión de fondo planteada en la demanda, luego de determinar si hubo o no violación de los derechos invocados.
El fallo proferido y el de segunda instancia, si hay lugar a ella, se enviarán a esta Corte, para su eventual revisión.

- Sexto. Laboral del Circuito de Santafé de Bogotá para que se pronuncie sobre la cuestión de fondo planteada en la demanda, luego de determinar si hubo o no violación de los derechos invocados. El fallo proferido y el de segunda instancia, si hay lugar a ella, se enviarán a esta Corte, para su eventual revisión.
