Se decretó la nulidad de todo lo actuado en la presente acción de tutela debido a la falta de notificación del Juzgado a las personas que, a pesar de no haber sido demandadas, tenían un interés legítimo en el resultado del proceso.
La Corte consideró que esto es una violación al debido proceso y por tal razón ordenó devolver el expediente para que surta nuevamente la primera instancia y con esto se garantice la protección del derecho de defensa.

- Primero. DECRETASE la nulidad de todo lo actuado en la presente accion de tutela, a partir, inclusive, del auto del Juzgado
- Segundo. Civil del Circuito Especializado de Medellin, de fecha doce (12) de diciembre de mil novecientos noventa y cuatro (1994).
- Segundo. ORDENASE a la Secretaria General de esta Corporacion, devolver el expediente de la referencia al Juzgado
- Segundo. Civil del Circuito Especializado de Medellin, para que previa la notificacion de la demanda de tutela a los senores Cruz Noel Botero Toro y Lucelly Botero Marin, surta nuevamente la primera instancia dentro del proceso de la referencia.
