Se decretó la nulidad de todo lo actuado en la presente tutela, a partir del auto de la Corte Suprema de Justicia, por la omisión íntegra de la segunda instancia.
En consecuencia, la Corte Constitucional garantizará los derechos fundamentales de los impugnantes al debido proceso y a la defensa.
Por lo anterior, se ordenó devolver el expediente de la referencia a la mencionada Corporación para que ésta decida sobre la impugnación presentada por los accionantes.

- Primero. DECRETAR la nulidad de todo lo actuado en la presente tutela, a partir, inclusive, del auto de la Corte Suprema de Justicia, Sala de Casación Penal, de fecha ocho (8) de abril de mil novecientos noventa y seis (1996).
- Segundo. ORDENAR que por la Secretaría se devuelva el expediente de la referencia a la Corte Suprema de Justicia, Sala de Casación Penal, para que ésta decida sobre la impugnación presentada por los señores Alvaro Montes Martínez y Antonio Zuluaga Patrón, contra la sentencia del Tribunal Superior del Distrito Judicial de Sincelejo, Sala de Decisión Penal, de fecha veinte (20) de febrero de mil novecientos noventa y seis (1996).
- Tercero. Para su eventual revisión, la Corte Suprema de Justicia, Sala de Casación Penal, una vez resuelva la impugnación, devolverá el expediente a esta Corte Constitucional.
