Se declaró la nulidad de todo lo actuado a partir del fallo de primera instancia proferido por el Tribunal en el proceso de la referencia, toda vez que omitió notificar a un tercero interesado.
En consecuencia, se ordenó al mencionado Tribunal reanudar el trámite, además, deberá notificar a la parte demandada y a la tercera persona interesada, a fin de que pueda hacer valer sus derechos y defender sus intereses, tal como lo consagra el artículo 29 de la Carta Política.
Una vez surtida la primera y segunda instancia, el expediente regresará a la Corte Constitucional para su eventual revisión.

- Primero. Declarase la NULIDAD de todo lo actuado a partir del fallo de primera instancia proferido por la Sala Civil del Tribunal Superior del Distrito Judicial de Santa Fe de Bogota, el tres (3) de marzo del presente ano.
- Segundo. ORDENASE al Tribunal reanudar el proceso. Este debera notificar a la parte demandada y a Maria Daisy Salazar de Gutierrez, la iniciacion del proceso de tutela.
- Tercero. El Tribunal dispondra tambien la notificacion de esta providencia a la sociedad demandante, "Construcciones Industriales LTDA. -COIN LTDA-".
- Cuarto. Una vez surtida la primera instancia y, en su caso, la segunda, regrese el asunto al Despacho del Magistrado Sustanciador de la Revision, para posterior examen de esta Sala.
