Se remitió el expediente T-778074 al Juzgado 23 Civil Municipal de Bogotá para que conforme a lo dispuesto por el Art. 27 del Decreto 2591 de 1991, adopte las decisiones necesarias para el cumplimiento de la Sentencia T-1078/03, así como respecto del incidente de desacato promovido ante ese despacho judicial por el ciudadano de la referencia en su propio nombre y en representación de su hija, toda vez que como fallador de primera instancia en la acción de tutela a que se ha hecho referencia no sólo tiene competencia para adoptar las medidas que fueren necesarias con el fin de hacer efectiva la orden judicial impartida en la citada sentencia sino, además, para tramitar el incidente de desacato promovido por el actor.

- En merito de lo expuesto la Sala Segunda de Revision de la Corte Constitucional,
- RESUELVE:
- Remitase el expediente T-778074 al Juzgado 23 Civil Municipal de Bogota, para que conforme a lo dispuesto por el articulo 27 del Decreto 2591 de 1991, adopte las decisiones necesarias para el cumplimiento de la Sentencia T-1078 de 13 de noviembre de 2003, asi como respecto del incidente de desacato promovido ante ese despacho judicial por el ciudadano Oscar Hernan Rincon Alfonso en su propio nombre y en representacion de su hija Laura Esperanza Rincon Munoz, al cual se refiere la parte motiva de esta providencia.
