Se revocó la providencia proferida por el Juzgado de la referencia, de acuerdo a lo que explicó la Corte para el presente caso, aunque fue acertada la declaración de incompetencia por parte del Juez, el procedimiento a seguir era ordenar el envío inmediato de la actuación al juez competente, previa notificación de esta actuación a la demandante y no lo dispuesto en la parte resolutiva de la providencia que se examinó.
En consecuencia, se le ordenó al Juez cumplir con el trámite correspondiente y comunicar a las partes de conformidad con lo dispuesto en el Art. 36 del Decreto 2591 de 1991.

- Primero. REVOCAR la providencia de marzo ocho (8) de mil novecientos noventa y seis (1996), proferida por el Juzgado
- Sexto. Penal del Circuito de Pereira, y, en su lugar, ordenar que dicho Juzgado proceda a remitir inmediatamente la demanda de tutela y sus anexos al juez competente, y a informar al demandante sobre dicha remision.
- Segundo. COMUNICAR esta decision al Juez
- Sexto. Penal del Circuito de Pereira, para que sean notificadas las partes, de conformidad con lo dispuesto en el articulo 36 del decreto 2591 de 1991.
