Primero. DEJAR SIN EFECTO el auto proferido por la Sala de Casacion Civil y Agraria de la Corte Suprema Justicia, el 26 de septiembre de 2007.
Segundo. REMITIR a la Sala de Casacion Civil y Agraria de la Corte Suprema Justicia, a fin de que asuma el tramite de la impugnacion que le fuera concedida al senor Arcesio Rodriguez Valero desde el 4 de septiembre de 2007 y profiera la decision de segunda instancia que corresponda, conforme a las previsiones del articulo 86 de la Constitucion Politica y del Decreto 2591 de 1991.
Tercero. Por Secretaria General, comuniquese a los despachos judiciales en colision la decision adoptada en esta providencia, con el fin de que tengan conocimiento sobre lo aqui resuelto por la Corte Constitucional en relacion con el conflicto de competencia.
