Se confirmó en todas sus partes el auto proferido por el despacho del magistrado ponente en el proceso D-3920, mediante el cual se rechazó la demanda presentada por el ciudadano de la referencia en contra del parágrafo (parcial) del Art. 24 y de los Arts. 40 y 42 de la Ley 712 de 2001.
Lo anterior, porque el demandante utilizó una vía legal inapropiada para revivir una oportunidad procesal caduca –la de corregir de la demanda- lo cual conduce a desestimar las pretensiones del recurso de súplica.

Pesantes R. en contra del paragrafo (parcial) del articulo 24 y de los articulos 40 y 42 de la Ley 712 de 2001.
