Conflicto de competencia suscitado entre el Juzgado Segundo Promiscuo Municipal de Cajicá y el Juzgado Treinta y Cuatro Civil Municipal de Bogotá.
La Sala reitera que el demandante puede presentar la acción de tutela ante los jueces, a prevención, para la protección de sus derechos constitucionales fundamentales, lo que implica que pueda elegir entre el lugar donde ocurrió la presunta vulneración y aquel en el cual se producen sus efectos.
Como quiera que la presunta trasgresión alegada produce sus efectos en Cajicá, considera la Corte que la solicitud de amparo debe tramitarse ante los jueces de esa jurisdicción.
En consecuencia, se remite el expediente al Juzgado Segundo Promiscuo Municipal de dicho municipio, para que asuma de manera inmediata y sin dilaciones su conocimiento.
