Se declaró que la Sala de Familia del Tribunal Superior del Distrito Judicial de Villavicencio sí tenía competencia para avocar el conocimiento de la presente acción de tutela, es así como revocó la decisión de la Sala de Casación Civil de la Corte Suprema de Justicia que declaró nula la actuación adelantada por el mencionado Tribunal.
En consecuencia, ordenó enviar el expediente de nuevo a la Corte Suprema de Justicia, para que se surta la segunda instancia y una vez dictada la sentencia correspondiente, lo devuelvan a la Corte Constitucional para su eventual revisión.

- PRIMERO. DECLARAR que la Sala de Familia del Tribunal Superior del Distrito Judicial de Villavicencio si tenia competencia para avocar el conocimiento de la presente accion de tutela.
- SEGUNDO. REVOCAR la decision de la Sala de Casacion Civil de la Corte Suprema de Justicia del veintisiete (27) de octubre de mil novecientos noventa y tres (1993), que declaro nula la actuacion adelantada por la Sala de Familia del Tribunal Superior del Distrito Judicial de Villavicencio.
- TERCERO. ORDENAR el envio del expediente a la Sala de Casacion Civil de la Corte Suprema de Justicia, para que se surta la segunda instancia. Una vez se dicte la sentencia correspondiente, las diligencias se devolveran a la Corte Constitucional para su eventual revision.
