Se presentó la causal de nulidad por no haberse notificado a una de las partes contra las cuales se interpuso la acción de tutela interpuesta por el demandante, toda vez que se incurrió en una violación al debido proceso.
Por lo anterior, la Corte ordenó al Juzgado correspondiente que proceda de conformidad con lo establecido en el Art. 145 del Código de Procedimiento Civil, modificado por el Decreto 2282 de 1989, Art. 1o. numeral 85.

- R E S U E L V E :
- PRIMERO. Como se observa que se ha presentado la causal de nulidad descrita en la parte motiva, por no haberse notificado a las señoras LUZ GIL, MARLENY RAMOS, BERTHA JIMENEZ, MARY MARTINEZ, AMPARO GERENA, ISABEL CASTAÑEDA, BEATRIZ GOMEZ, MIRYAM OSPINA y al señor FABIO GIL de la acción de tutela incoada por el señor Mario Sánchez Escobar, se ORDENA al Juzgado
- Segundo. Promiscuo Municipal de Circasia, que proceda de conformidad con lo dispuesto en el artículo 145 del Código de Procedimiento Civil, modificado por el Decreto 2282 de 1989, art. 1o. numeral 85, por las razones expuestas en la parte motiva del presente auto.
- SEGUNDO. ORDENAR que por intermedio de la Secretaría General de esta Corporación, se devuelva el expediente radicado bajo el número No. T- 52600 al Juzgado
- Segundo. Promiscuo Municipal de Circasia, para que proceda de conformidad con lo señalado en el numeral anterior.
