Se remitió el expediente al Tribunal Superior del Distrito Judicial de Bogotá Sala Penal para que adelante la correspondiente actuación judicial.
Por lo anterior, la Corte explicó que si bien se encuentra vigente el Decreto 1382 de 2000, conforme a la situación jurídica existente en la actualidad, en el caso concreto se hace necesario acudir a la regla general prevista en el Art. 37 del Decreto 2591 de 1991.
Tal aplicación se hace necesaria puesto que las decisiones tomadas por parte del Consejo Superior de la Judicatura Sala Disciplinaria se profieren por la Sala Plena.
En consecuencia, de llegar a conocer en primera instancia de la tutela, se le estaría vedando la posibilidad a las partes de acceder a instancia superior mediante la impugnación, lo cual contraviene abiertamente la Constitución.
