Conflicto de competencia, el proceso le correspondió por reparto a la Sala Civil Familia del Tribunal Superior del Distrito de San Gil dicho Tribunal ordenó la remisión del expediente a nuevo reparto ya que la demanda se dirige a juez administrativo, el Juzgado Administrativo de Circuito de San Gil, no avocó el conocimiento del expediente y ordenó su devolución.
La Sala recuerda que en virtud de los principios de informalidad, sumariedad y celeridad, el Tribunal Superior del Distrito Judicial de San Gil fue a la autoridad a quien le correspondió el reparto y por lo tanto ha debido darle trámite.

- Primero. DEJAR SIN EFECTOS el auto de fecha 1º de diciembre de 2009, proferido por la Sala Civil-Familia-Laboral del Tribunal Superior del Distrito Judicial de San Gil.
- Segundo. REMITIR a la Sala Civil-Familia-Laboral del Tribunal Superior de San Gil, el expediente de la referencia para que de forma inmediata, continúe el trámite de la primera instancia y profiera decisión de fondo respecto del amparo solicitado por el señor Pedro Felipe Romero Romero, conforme a las previsiones del artículo 86 de la Constitución Política y del Decreto 2591 de 1991.
- Tercero. Por Secretaría General, comuníquese al Juzgado Administrativo del Circuito de San Gil, la decisión adoptada en esta providencia, con el fin de que tenga conocimiento sobre lo aquí resuelto.
