Se declaró inhibida para resolver sobre el auto de la referencia, por carecer de competencia constitucional y legal para ello, consideró la Corte que la providencia del Tribunal no tiene el carácter ni la naturaleza de una sentencia de tutela que, por tanto, pueda esta Corporación revisar en ejercicio de sus facultades.
En ese sentido la Corte decidió devolver el expediente al Tribunal de origen.
