La Corte Constitucional argumentó que no tiene competencia para ordenar la prórroga solicitada debido a que no es posible realizar modificaciones a una sentencia porque pugna con el principio de la cosa juzgada.
Sobre el caso en particular, la Corte explicó que la providencia dictada debe ser obedecida y satisfecha en forma, ágil, pronta y concreta, por lo que al juez de primera instancia debe adoptar las decisiones para proteger el derecho tutelado.
En consecuencia, se regresó el expediente al Tribunal de origen para que ejecute el fallo.

- PRIMERO. La Corte Constitucional no tiene competencia para ordenar la prorroga que se solicita.
- SEGUNDO. Regrese, de inmediato, el expediente al Tribunal de origen para que adopte las decisiones necesarias para que las ordenes dadas en el fallo sean eficaces.
- Por la Secretaria de la Corporacion se dara cumplimiento a lo anterior.
