Se declaró la nulidad de todas las actuaciones surtidas en la presente tutela desde el auto admisorio de la misma proferido por el Juzgado Sexto Civil del Circuito de Ibagué, toda vez que se omitió la notificación de un tercero con interés legítimo.

En consecuencia, se ordenó al citado Juzgado reiniciar la tutela interpuesta por el ciudadano de la referencia, previa notificación a la Secretaria de Salud del Departamento del Tolima, así como a todas aquellas entidades que en su criterio deban ser vinculadas al proceso.

Surtido dicho trámite, la tutela seguirá el trámite señalado en el Decreto 2591 de 1991.

  1. Primero. DECLARAR la nulidad de todas las actuaciones surtidas en la presente tutela desde el auto admisorio de la misma proferido el veinticuatro (24) de junio de 2002 por el Juzgado
  2. Sexto. Civil del Circuito de Ibagué.
  3. Segundo. ORDENAR, al Juzgado
  4. Sexto. Civil del Circuito de Ibagué que reinicie la tutela interpuesta por Libardo García, previa notificación a la Secretaria de Salud del Departamento del Tolima, así como a todas aquellas entidades que en su criterio deban ser vinculadas al proceso. Surtido dicho trámite, la acción de tutela seguirá el trámite señalado en el decreto 2591 de 1991.
  5. Tercero. Por Secretaría, REMITIR el expediente de la referencia al Juzgado
  6. Sexto. Civil del Circuito de Ibagué, a fin de que se surta el trámite indicado en el numeral anterior.
