Conflicto de competencia suscitado entre el Juzgado Primero Penal del Circuito de Chinchiná (Caldas) y el Juzgado Cuarto de Familia de Manizales.
La controversia se fundó en las diferentes interpretaciones que hicieron los despachos involucrados respecto del factor territorial.
Considera la Corte que la autoridad competente para resolver la acción de tutela es el de Manizales, porque fue el que a prevención eligió el accionante y al que le fue asignado el trámite en primer término.
Se dispone enviar el expediente a dicho juzgado para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Cuarto. de Familia de Manizales, el 31 de agosto de 2017, mediante el cual se declaró sin competencia para conocer de la acción de tutela presentada por el ciudadano Pablo Felipe Arango Tobón, quien actúa en representación de la Empresa Metropolitana de Aseo de Chinchiná S.A. E.S.P. -EMAS-, contra el Servicio Nacional de Aprendizaje -SENA-.
- SEGUNDO. REMITIR el expediente ICC-3123 de la referencia al Juzgado
- Cuarto. de Familia de Manizales, que contiene la acción de tutela formulada por el ciudadano Pablo Felipe Arango Tobón, para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
