Rechazó la solicitud de consulta pretendida por el actor de la referencia motivo por el cual se abstuvo de formular consideraciones sobre el caso en cuestión.
Lo anterior, al considerar que no es función de la Corporación emitir conceptos sobre el comportamiento que deba asumir un funcionario, organismo o entidad estatal en casos concretos.
Es preciso indicar que la única posibilidad de consulta a la Corte está referida a sus propias sentencias en asuntos constitucionales, a petición de un juez de la República para proteger derechos constitucionales no considerados en aquéllas (Art. 24 del Decreto 2067 de 1991).
