1En Los Municipios Con Población Total Hasta De Treinta Mil (302Para La Contratación Del Servicio De Transporte Escolar Por Parte De Los Establecimientos Educativos O Entidades Territoriales De Los Municipios A Que Se Refiere El Artículo 1° Del Presente Decreto, Se Deberán Previamente Comunicar Las Necesidades De Este Servicio A Por Lo Menos Tres (3) Empresas De Transporte Habilitadas En El Servicio Público De Transporte Terrestre Automotor Especial, Con Domicilio En Los Municipios Geográficamente Más Cercanos3La Contratación Del Servicio De Transporte Escolar Por Parte De Las Entidades Territoriales O Establecimientos Educativos, Podrá Igualmente Realizarse Con Empresas De Servicio Público De Transporte Terrestre Automotor Mixto O Colectivo Municipal Legalmente Constituidas Y Habilitadas, En Aquellas Entidades Territoriales En Las Que Existiendo Empresas De Servicio Público De Transporte Terrestre Automotor Especial Habilitadas En Los Términos De La Resolución 3097 De 2009 Expedida Por El Ministerio De Transporte, La Entidad Territorial O Establecimiento Educativo Acredite La Inexistencia Material De Este Servicio4El Presente Decreto Rige A Partir De La Fecha De Su Publicación
