Art. 9. ° No tendrán derecho á pensión las viudas, hijos ó madres que poseyeren bienes de fortuna suficientes para su congrua sustentación, á juicio de la Junta Directiva del Montepío ; ó cuando el militar su antecesor haya recibido en vida la recompensa de sus servicios; ó si les dejó una pensión pagadera por el Tesoro público ; pero en el último caso pueden cambiarla por la que les corresponda en el Montepío. Tampoco tendrán derecho á pensión si el militar fue dado de baja por mala conducta ó deslealtad al gobierno; si fue condenado por Tribunal competente á la pérdida de su grado, y no se rehabilitó ; ó finalmente, si fue condenado á pena corporal infamante ó á perder toda pensión del Tesoro, y el militar falleció durante la pena.
