El militar que con ocasión del servicio o de funciones inherentes a su cargo o aprovechándose de su calidad de militar y con el propósito de causar una lesión personal ocasione la muerte de otro, incurre en la sanción establecida en el artículo primero de este Capítulo, disminuida de una tercera parte a la mitad.
