La presente ley entrará en vigencia con su promulgación y, su aplicación se efectuará de manera gradual de conformidad con lo dispuesto en el artículo 16 de la presente ley; deroga todas las disposiciones que le sean contrarias, especialmente el artículo 38, el numeral 1 del literal c) del artículo 41 modificado por el artículo 20 de la Ley 712 del 2001 y los artículos 81 y 85, modificado por el artículo 42 de la Ley 712 de 2001 , del Código Procesal del Trabajo y de la Seguridad Social.
