Incurre en separación temporal, de un mes a un año, el Oficial o Suboficial que comete alguno de los siguientes hechos, siempre que no estén previstos como delitos:

1° Atacar por vías de hecho a un inferior, fuera del servicio;

2° Usar sin la debida autorización naves aéreas, fluviales o marítimas;

3° Abusar manifiestamente de las atribuciones que le son propias, privando a otro militar de su libertad, y

4° Transportar sin la debida autorizaci6n, en naves aéreas, marítimas o fluviales, personas o cosas.
