Los procesados sobreseídos o absueltos o a cuyo favor se hubiere cesado el procedimiento en primera instancia y los que hubieran sufrido en detención preventiva un tiempo igual a la pena imponible por el delito, en todo caso, serán libertados provisionalmente.
