A nadie se podrá detener provisionalmente sino en virtud de un auto del funcionario instructor en que se exprese:

El hecho que se investiga en el proceso;

Los elementos probatorios allegados sobre la existencia de ese hecho;

Su calificación legal y la pena que la ley establece para él, y

Los elementos probatorios allegados al proceso en contra de la persona cuya detención se ordena.
